These terms govern access to the If Not Now console, operated by 97 Music Group Ltd ("we"). By signing in you accept them.
Accounts are issued by an administrator and are personal to the individual named on them. Do not share credentials. We may suspend an account for misuse, for non-payment where fees apply, or where continued access would breach a third party's terms.
You connect your own Meta advertising assets. You confirm you are authorised to use them and to advertise the material you upload. You remain responsible for all advertising spend. The console creates and edits campaigns at your instruction; budgets, targeting and creative are your decisions, and spend is charged to you by Meta directly, not by us.
You keep ownership of the audio, artwork, video and copy you upload. You grant us only the licence needed to host it and deliver it to the advertising platforms you have connected. You are responsible for holding the rights to it.
Where you operate a smart link you are the controller of that link's audience data and we act as your processor. You are responsible for having a lawful basis for the tracking described in the Privacy Policy, including any consent required in the territories you advertise into, and for your own privacy notice where one is required.
The console depends on Meta, Clerk, Resend and, where enabled, Songstats. Their availability, rules and API behaviour are outside our control, and changes on their side can affect what the platform can do.
The platform is provided without warranty of uninterrupted or error-free operation. To the extent permitted by law we are not liable for advertising spend, lost revenue, lost profits or lost data. Nothing here limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot be limited by law.
Where an agency fee is agreed it is set out separately. Fees shown inside the console are a calculation aid, not an invoice.
Either party may end access at any time. On termination we will, on request, delete your account data. Campaigns already live on Meta remain yours to manage in Meta.
These terms are governed by the laws of England and Wales, and the courts of England and Wales have exclusive jurisdiction.
These terms may be updated from time to time; continued use constitutes acceptance of the current version.
